Error, when uploading an empty file

hi, it took me a while to figure out, but i finally figured that cyberduck gives me an error when I upload an empty file. this is a text file with 0 kb content. the error is only FTP Error: Upload failed. this is with Cyberduck-5484.tar.gz nightly build as well as current stable 3.2.1 on osx 10.5.8
